Mrs Wainwright and her son won their case against the British Government at the European Court of Human Rights on September 26. The court said they had been unable to obtain redress because of the absence of a tort of privacy in English law. Does this mean that Britain is required to enact a privacy law? Probably not, although the judgment brings the prospect of a judge-made tort a little closer. Read my discussion of the case in today's Telegraph.
